We previously examined bicycle safety tips and ways for cyclists to avoid injuries on the road. What many drivers don’t realize is bicyclists have the same rights as the driver when traveling on the streets.
Tennessee Law Regarding Cyclists
While the city of Memphis has done an admirable job in carving out dedicated bicycle lanes across the city, there are times and places when a cyclist does not have such an option. T.C.A. 55-8-175 explores some of the Tennessee law regarding passing a cyclist on the roadway. In general, Tennessee law grants a bicyclists all of the same rights afforded to a motor vehicle and driver.
During these instances, drivers must realize that, legally, cyclists have the right of way and are lawfully entitled to proceed in a lane of traffic normally reserved for automobiles.
T.C.A. 55-8-143 dictates that if you want to pass a cyclist in a lane of traffic, you must do so by signaling and moving to another lane of traffic. Likewise, a bicyclist must use proper signals when turning or coming to a stop. Over the years, we have represented many riders who have been injured on the streets due to the negligence of another driver. The one common key in many of these cases has been impatience. Typically, the impatience of a driver when faced with a cyclist on the roadway has led to an otherwise avoidable accident.
