Can I Afford an Attorney?

One of the most common questions a potential client will ask is, “How much do you charge for your services?”

The answer can vary greatly depending on the type and complexity of your legal matter. There are times that you may think you need a legal representative but learn later on that an attorney was not needed. For instance, if you were at fault in an automobile accident that resulted in injuries to the other party you may become part of any potential litigation. 

You do not need an attorney to represent your interest, assuming you had valid automobile insurance at the time of your accident. In these cases, your insurance company will pay for the cost of your defense and obtain a lawyer to represent your (and their) interests. 

Automobile accidents

If you were injured in an automobile accident you will definitely need the services of an experienced attorney. We always recommend that you interview more than one attorney before making a decision. In our previous blog post, Choosing the Right Law Firm we addressed the need to find an attorney that offers free consultations. If you were injured in an accident, most attorneys will work on a contingency basis and any possible fee will only come if he/she is successful in getting you money.

Most attorneys take 33 percent of any recovery for automobile accident claims plus expenses. At The Chiozza Law Firm we put in writing that our fees are never to exceed more than 25% of any recovery in most automobile accident cases, as we believe the client being the person who suffered, should get the bulk of any settlement. 

Be Aware of "Up-Front" Attorneys

One should also be aware that if an attorney is asking a client to pay for his/her expenses up front, out of their own pocket, then it may be time to consult with a new attorney. Our law firm will pay for all expenses, including filing fees and any costs associated with obtaining an expert, so that you will not be out any money during the legal process. If we happen to be unsuccessful in pursuing your claim, you will never have to repay us for any expenses that were paid out in your matter. 

Criminal cases

The question of fees most often arises in criminal defense cases. Fees for representation depend on the type of criminal case. A fee for representation will obviously be higher for a felony charge than that of a typical misdemeanor. 

When looking for a criminal defense attorney, you should ask about payment plans for their representation and what to expect. You want to choose a reputable attorney and make sure all fee matters are agreed to up front. If an attorney takes your case and tries to charge you more later on, then you should start asking questions such as:

  • Why am I being charged more now?
  • Shouldn’t you have seen this when I first hired you?

Your attorney should be able to provide you with his/her cell phone number so that you can be in contact with them as needed. Also be wary of an attorney who guarantees results without knowing all of the facts of your case. All criminal cases are different and require a certain level of knowledge about the case before knowing what to fully expect or guarantee.

While almost every criminal case will require you to hire an attorney, we believe that you will find our fees for criminal defense representation to be extremely reasonable. What if I can't afford an attorney?

If you cannot afford to hire an attorney for your legal matters, you may seek advice from a legal aid group in your city. In Shelby County Memphis Area Legal Services and The Memphis Bar Association provide services for those in need.

Understand that attorneys are not free, but the fees they charge can at least be reasonable in nature.
