Do You Have a Claim If There Is No Accident Report?

The accident report is one of the greatest pieces of information you can have to ensure that the claims process goes smoothly with the appropriate insurance company. Auto accident scenes are hectic and stressful, so an accident report can help sort thru the confusion to provide a clear understanding of what happened and which involved party was at fault.  

A common question asked by potential clients is, “Can I still pursue a claim if the officer did not do an accident report?” The short answer is absolutely, but it does make the process more difficult. In most circumstances an officer will include witness and driver statements, photographs, party information, and an opinion as to fault based on the circumstances, which will all be included in the accident report. While not always correct, the accident report is usually a good indicator as to who was at fault.

Without an accident report it can be difficult to obtain witness statements and get a clear view of the circumstances leading up to and during the accident. There are many instances when a report cannot be taken, such as inclement weather or a collision on private property. When this occurs, you must do your best to take pictures and obtain the other driver’s information, along with witness statements. You should then go your local police present to see if an officer will file a late report based on the information you can provide.

Without a report it is usually up to the involved parties to tell the insurance company what happened. Unfortunately, people sometimes tend to reshape the truth to his/her benefit when speaking with the insurance carrier so that they don’t have an accident on their record.
