Drag Racing Penalties in Tennessee

If you live near Downtown Memphis, you know that drag racing has become a major issue. Drag racing can pose a serious risk to pedestrians and other drivers on the roadways. As of today, if you are found guilty of drag racing in Memphis or The State of Tennessee you are facing penalties in accordance with a Class B Misdemeanor, which is a maximum six-month jail sentence. In the past, the punishment for drag racing rarely involved a jail sentence. According to a new article published by The Daily Memphian found here, the proposed legislation would make the criminal penalties for those found guilty of Drag Racing very serious.

Drag Racing May Become a Class A Misdemeanor in Tennessee

As noted in The Daily Memphian Article, a newly proposed law would make Drag Racing a Class A misdemeanor, punishable by up to 11 months and 29 days in jail. In addition to almost doubling potential jail time, the new legislation may give officers the ability to seize the vehicle the defendant was operating at the time of the alleged crime. We believe the ability to seize one’s vehicle would be a greater deterrent than just about any potential criminal punishment. The process one must go through to recover a seized vehicle is complicated, time-consuming, and expensive.

The Statistics

Statistics mentioned in the Daily Memphian article state that in 2020 alone there have been over 32,000 traffic accidents, up from an average of 25,000. There have also been 52 pedestrian fatalities this year, a significant increase from 2019. Increased potential jail time and the possibility of car seizures will be enough to put an end to drag racing on the Memphis streets.
