All Attorneys Claim “Free Consultations” - What You Need to Really Know

People Signing Legal Papers

When looking for legal representation, most people will choose the first attorney they meet without getting a second opinion. Many of these potential clients are lured in by the phrase “free consultation”. While a “free consultation” should mean just how it reads, we have found that is not always the case.

Things To Look Out For With “Free Consultations”

When interviewing an attorney, clients should avoid those who make the following demands during their free consultation:

You Will Be Billed for Investigation Hours

For auto accident cases, look out for any plaintiff’s attorney who says the first meeting is free but any investigation will have to be billed by the hour. It is probably safe to assume this lawyer just wanted to get you into their office to secure hourly, billable representation with no guarantee of success.

You Are Responsible for Paying Filing Fees

If the attorney says he or she will take your case, but you will be responsible for paying any filing fees or expenses as the case proceeds, be wary of this type of agreement. Any attorney with confidence in your case and legal expertise will pay for all costs and expenses as long as the case is ongoing. Reputable attorneys will guarantee that you pay nothing unless he or she is successful in securing a monetary settlement or judgment.

Expert Witness Fees

If an attorney tells you will be responsible for paying any expert witness fees related to your case, you should probably look elsewhere. As mentioned above, expert witness fees are an expense your attorney should pay for, not the client.
