While most misdemeanor cases are resolved at the General Sessions level, many felony charges will usually go to the grand jury for indictment and subsequent proceedings in Shelby County Criminal Court.
When Are Cases Presented To A Grand Jury?
Cases will usually proceed to the grand jury for presentment after a preliminary hearing at the General Sessions level or a signed waiver bind-over voluntarily submitting the case to the grand jury for indictment. The grand jury is comprised of a group of individuals who will listen to prosecutor and witness statements to determine if there is sufficient evidence to charge an individual with the crime presented. The accused and their legal representative do not appear at the hearings nor do they present any evidence on their behalf.
What To Expect At Grand Jury Proceedings
At the grand jury proceedings, they can choose to either issue an indictment for further proceedings or choose to issue a “no true bill,” which is basically a dismissal of the charges. In some instances, a prosecutor will submit a case directly to the grand jury for indictment without ever presenting the case at the General Sessions court level. This is called a “sealed indictment.”
What Happens If You’re Indicted
If you are indicted, you will receive notice in the mail of your assigned courtroom and the date on which to appear. Your case will then start over and you as the accused will have the right to discovery and a jury trial, should your attorney request such.
