Punishment for Domestic Violence in Memphis, TN

The crime of domestic violence in Memphis, TN carries a punishment that is different from other convictions. If you are charged with domestic violence in Memphis, TN you will usually be charged with domestic simple assault or aggravated assault.

Domestic simple assault is considered a Class A misdemeanor, meaning it is punishable by up to 11 months and 29 days in jail.  The amount of time one serves will vary from case to case, depending on the severity of the assault, the history of the accused, and the wishes of the alleged victim.  A defendant who is convicted of sexual assault but is not ordered to serve jail time will usually be placed on supervised probation. While the defendant won’t be arrested during the probationary period, they will usually be instructed to participate in some type of domestic assault/anger management program and complete community service.

The domestic crime of aggravated assault involves causing bodily harm via strangulation or the use of a deadly weapon. This is usually considered a Class C felony, punishable by up to 15 years in prison.

For both of the domestic charges above, the defendant is eligible for diversion.  Diversion is a program for first-time offenders where charges can be erased from their public record assuming they stay out of trouble and complete all conditions of the diversion program.

For those not eligible for diversion in Memphis, TN, a conviction or guilty plea to a domestic assault can be difficult to overcome.  As previously stated, a conviction for a domestic assault offense comes with additional punishments that other crimes do not. If a domestic violence conviction or guilty plea shows up in your background check, you will not be able to purchase or possess a firearm for the duration of your life, even if your goal was to become a cop or security guard.
