When a Car Accident Becomes a Crime

Car accidents are usually just what the words imply. An accident. An unintended action due to the negligent driving of another.

While these matters can have serious and life-altering consequences, the remedy for accident claims is usually reserved for Civil Court. In Civil Court, a Plaintiff can recover monetary damages for pain and suffering, lost wages, medical expenses and other allowable damages related to an auto accident.  

Usually, the at-fault driver is issued a moving violation and ordered to appear in City Court. In these cases, the driver will usually pay the mandatory fine associated with the moving violation, and the matter is over.

In the state of Tennessee, in certain instances, the at-fault driver can be charged criminally for certain actions.

Criminal charges related to an accident are the following:            

Reckless Driving

If the at-fault driver was operating his or her vehicle in an extremely dangerous or aggressive manner (including driving far above the speed limit), an officer may elect to file criminal charges for reckless driving.

Leaving the Scene of An Accident

If you are involved in an accident and subsequently leave the accident scene, you will be criminally prosecuted. If you leave the scene of an accident involving an injury to the victim, the punishment can be increased in the State of Tennessee.k

Driving Under the Influence

Driving Under the Influence of Drugs or Alcohol is one of the deadliest and life-altering criminal offenses for everyone involved. If you are found to be under the influence at an accident scene, you will be charged and the punishment for a DUI involving an accident or injury increases jail time and punishment significantly.  

Should you find yourself involved in an accident, the best advice is to stay put and wait on an investigating officer. As with most things, avoiding the problem and running only leads to more problems and certain criminal prosecution.
