Fall is upon us in the Mid-South, which means rainy weather, hazardous conditions and a few days of snow not too far away. With a change in seasons and daylight savings time comes an increase in weather related auto accidents. One of the more common questions we get asked is, “if the rain, snow, light conditions or even wind caused me to have an accident then I’m not liable, right?”
The short answer to the question is you are liable even if your accident was due to rainy streets or icy roads. For instance, if you are traveling down Poplar Avenue in Memphis, TN and you apply your brakes, but you still slide into the car in front of you due to icy roads you are still responsible for any damages you cause to the other vehicle and driver.
The reason for this is the law states that in most cases you are responsible for the operation of your vehicle, while taking into consideration road and weather conditions. The law mandates that each driver must take extra precaution when operating a vehicle given hazardous conditions. Regardless of weather conditions, whoever is at fault will be liable for damages.
With that being said, another contributing factor to an increase in auto accidents in Memphis besides weather is the Holiday season travel increase. It is inevitable that with an increase in Holiday traffic this Thanksgiving and Christmas there will be more accidents.
