Who Pays For a Rental Car Following an Accident?

How Long Can You Keep the Rental Car? 

As we all know, things don’t often go smoothly with insurance companies during the claims process following an auto accident. No matter whose insurance company is paying for your rental vehicle, you are authorized to use said vehicle until repairs to your car have been completed or until a totaled vehicle is paid off to yourself or a finance company. After payment or repairs are completed, you do not have a legal right to be in the rental vehicle, and it must be returned. Otherwise, you will be responsible for daily charges.

If you are in immediate need of a replacement vehicle following an accident, we recommend that you call your own insurance company and seek a vehicle under the Rental Car Reimbursement provision of your policy. While you may have to pay a deductible, you can seek reimbursement for the deductible at a later time from the at fault party’s insurance company.

If you can wait a short amount of time before seeking a rental vehicle, then it is usually best to file a claim with the at fault party’s insurance company.  Following their investigation, the insurance company can put you in a rental vehicle at no out-of-pocket costs to you. After you file a claim with the third-party insurance carrier, make sure you or your attorney submit an accident report to held speed up the claims process. We always stress the importance of an accident report, as it will help sort out any disputed facts for the insurance company and contain any related witness information.

If your claim has been denied, and you have no insurance of your own, then you may not have a choice but to pay for a rental out of pocket. If you are paying for a vehicle yourself, make sure to keep all receipts and related expenses.
